This Acceptable Use Policy (“Policy“) forms part of our Terms of Use (“Legal Terms“) and should therefore be read together with our main Legal Terms: stag-wp.evalartapp.com/terms. - Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any part of the Services.
- Remove copyright or other proprietary rights notices from any Content.
- Copy or adapt the Services’ software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
- Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other harmful material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
- Upload or transmit (or attempt to upload or transmit) any material that acts as a passive or active information collection or transmission mechanism, including clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or similar devices (sometimes referred to as “spyware” or “passive collection mechanisms”).
- Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorized script or software.
- Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Services.
- Use the Services in a manner inconsistent with any applicable laws or regulations.
- If you subscribe to our Services, you understand, acknowledge, and agree that you may not, except as expressly permitted:
- Make any use, including modification, copying, redistribution, publication, display, performance, or retransmission of any part of the Services other than as expressly permitted by this Policy without the prior written consent of Noosa Labs, Inc., which may be granted or withheld in its sole discretion.
- Reconstruct or attempt to discover any source code or algorithms of the Services, or any part thereof, by any means.
- Intercept any data not intended for you.
- Damage, disclose, or alter the data of any user or any other hardware, software, or information belonging to another person or entity.
CONTRIBUTIONS
For the purposes of this Policy, “Contributions” means:
- Any data, information, software, text, code, music, scripts, sounds, graphics, photographs, videos, tags, messages, interactive features, or other materials that you post, share, upload, submit, transmit, or otherwise provide on or through the Services; or
- Any other content, material, or data that you provide to Noosa Labs, Inc. or use with the Services.
Certain areas of the Services may allow users to upload, transmit, or publish Contributions. We may, but are under no obligation to, review or moderate Contributions made through the Services, and we expressly disclaim liability for any loss or damage resulting from any user’s violation of this Policy. We encourage you to report any Contribution that you believe violates this Policy; however, we will determine, in our sole discretion, whether a Contribution actually violates this Policy.
You warrant that:
- You are the creator and owner of, or have the necessary licenses, rights, consents, releases, and permissions to use and authorize us, the Services, and other users of the Services to use your Contributions in any manner contemplated by the Services and this Policy.
- All of your Contributions comply with applicable laws and are original and truthful (whether expressing opinions or facts).
- The creation, distribution, transmission, public display, performance, access, downloading, or copying of your Contributions does not and will not infringe any proprietary rights, including copyrights, patents, trademarks, trade secrets, or moral rights of any third party.
- You have obtained the verifiable consent, release, and/or permission of every identifiable individual featured in your Contributions to use their name or likeness in connection with the Services and this Policy.
You further agree not to post, transmit, or upload any Contribution that:
- Violates any applicable law, regulation, court order, contractual obligation, this Policy, our Legal Terms, or any legal duty, or promotes or facilitates fraud or illegal activities.
- Is defamatory, obscene, offensive, hateful, insulting, intimidating, harassing, abusive, or threatening.
- Is false, inaccurate, or misleading.
- Contains child sexual abuse material or otherwise violates laws relating to child protection.
- Solicits personal information from anyone under the age of 18 or exploits minors sexually or violently.
- Promotes violence, advocates the violent overthrow of any government, or incites, encourages, or threatens physical harm against another person.
- Is obscene, lewd, lascivious, filthy, violent, harassing, libelous, sexually explicit, or otherwise objectionable.
- Discriminates on the basis of race, sex, religion, nationality, disability, sexual orientation, or age.
- Harasses, intimidates, humiliates, or insults any person.
- Promotes, facilitates, or assists acts of terrorism.
- Infringes, or assists others in infringing, any intellectual property rights or rights of publicity or privacy.
- Misrepresents your identity or affiliation with any person or entity.
- Contains unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
- Misrepresents the origin of the Contribution.
REPORTING A VIOLATION OF THIS POLICY
We may review or moderate Contributions made through the Services, but we are not obligated to do so and expressly disclaim liability for any loss or damage resulting from violations of this Policy.
If you believe that any Content or Contribution:
- Violates this Policy, please email us at evalart@stag-wp.evalartapp.com and explain which Content or Contribution violates this Policy and why; or
- Infringes any third party intellectual property rights, please email us at evalart@stag-wp.evalartapp.com.
We will reasonably determine whether any Content or Contribution violates this Policy.
CONSEQUENCES OF BREACHING THIS POLICY
The consequences of violating our Policy will vary depending on the severity of the violation and the user’s history on the Services. For example:
In some cases, we may issue you a warning and/or remove the offending Contribution. However, if your violation is serious or if you continue to violate our Legal Terms and this Policy, we reserve the right to suspend or terminate your access to and use of our Services and, where applicable, deactivate your account. We may also notify law enforcement authorities or initiate legal proceedings against you where we believe there is a genuine risk to an individual or a threat to public safety.
We disclaim all liability for any actions we may take in response to any of your violations of this Policy.
COMPLAINTS AND RESTORATION OF LEGITIMATE CONTENT
If you believe that any Content or Contribution has been removed or blocked from the Services in error, please contact us using the contact details provided at the bottom of this document, and we will promptly review our decision to remove such Content or Contribution. The Content or Contribution may remain “disabled” while we conduct the review process.
DISCLAIMER
Noosa Labs, Inc. has no obligation to monitor user activity and disclaims all responsibility for misuse of the Services by any user. Noosa Labs, Inc. assumes no responsibility for any Content or Contribution created, maintained, stored, transmitted, or made available through the Services and is under no obligation to monitor or exercise editorial control over such material. If Noosa Labs, Inc. becomes aware of any Content or Contribution that violates this Policy, it may remove such Content or Contribution, disable the associated account, and report the matter to law enforcement or the appropriate regulatory authority. Unless otherwise stated in this Policy, Noosa Labs, Inc. disclaims any duty to any person who has not entered into an agreement with Noosa Labs, Inc. for the use of the Services.
